What to Do When Roommate Moves Out Before Lease Ends

Roommate is breaking the lease early and leaving you holding the bag? Here's what to do when your roommate moves out before the lease ends — step by step.

Your roommate just told you they’re moving in three weeks. The lease has six months left. They said “we’ll figure it out” with the same energy people use to say “I’ll Venmo you later.” You did not sign up to pay double rent.

If you’re trying to figure out what to do when your roommate moves out before the lease ends, this is one of the highest-stakes roommate situations you can hit. There’s a lease involved, real money involved, and a friendship that may or may not survive the next 60 days. Here’s how to handle each piece.

Who’s legally on the hook when a roommate breaks the lease?

The lease is the lease. If both names are on it and your roommate moves out, they are still legally responsible for their share of rent until lease end — unless they formally get released by the landlord.

That sounds reassuring. In practice, it isn’t. Landlords don’t chase a tenant who moved out. They go to whoever is still in the apartment, because that’s who they can reach. Which means even though your roommate “owes” the rent, you are the one who’ll get the late notice if they stop paying.

So step one is not the conversation. Step one is the lease. Pull it up today. Look for the early termination clause, the subletting clause, and the roommate replacement clause. Take a screenshot. That’s your map.

How do you find a replacement roommate fast?

The cleanest exit for everyone is a sublet or replacement tenant. Your roommate’s name comes off the lease (or stays on as a backstop), a new person moves in, and rent keeps getting paid in full.

To make that happen in under 30 days:

  • Post the room within 48 hours. Use Facebook Marketplace, your school housing group, r/[your city]Roommates, and Craigslist. Five channels, same post. Good photos. Honest description. List the rent at the actual amount — undercutting attracts flakes.
  • Screen fast. A 15-minute video call before anyone visits. Ask about work, schedule, lease history, pets. You’re not interviewing — you’re filtering.
  • Get landlord approval before signing anything. Most leases require the landlord to approve any replacement tenant. Send their info over for a credit check. Skipping this step can void the swap entirely.
  • Put it in writing. A short two-page roommate agreement covering rent, utilities, security deposit handling, and move-in date. Saves you three arguments later.

If you can’t find anyone in 30 days, talk to your landlord about formally adding their name in exchange for releasing your roommate. Some landlords will. Some won’t. Worth asking.

What if they refuse to pay until you find a replacement?

This is where it gets ugly. Some roommates leave and say “I’m done — find someone or it’s on you.” Legally, they’re still on the lease and still owe their share. Practically, getting that money out of someone who’s already across town is hard.

Three moves that actually help:

  • Get the commitment in writing. Text or email: “Confirming you’ll continue paying your half of rent until a replacement is found or the lease ends, whichever comes first.” If they agree, you have proof. If they refuse, you know what you’re dealing with.
  • Pay only your share to the landlord. Same logic as a roommate paying rent late. Don’t front their portion. Let the landlord chase them directly.
  • Hold their security deposit accountable. When the lease ends, their share of the deposit goes toward any unpaid rent or damage they caused. Document everything.

If they ghost completely and stop paying, small claims court is an option. It’s slow, it’s a hassle, and it works. Document every rent payment you covered for them and every text where they agreed to pay.
