Roommate moved out and skipped last month's rent? Here's what to do when a roommate leaves without paying their share, step by step.

They moved out on the first. Their room is empty. Their name is still on the lease. And the rent payment they were supposed to send hit your bank account as: nothing.

If your roommate left without paying last month’s rent, the short answer: pay the landlord in full to protect your lease and credit, document everything in writing, and then pursue the roommate for their share separately — through their guarantor, their security deposit, or small claims court. Don’t skip the landlord payment while you figure it out.

Here’s the full order of operations.

Pay the landlord first — even though it feels wrong

This one hurts. But it’s the most important move.

Your name is on the lease. Legally, the landlord doesn’t care which roommate paid. If rent is short, it’s your late fee, your eviction risk, and your credit hit. The landlord’s dispute is with all leaseholders — meaning if your roommate ghosts, you’re the one who eats the consequences by default.

Cover the shortfall from your own account. Save the confirmation. This does two things: it keeps your lease clean, and it makes you the person with a documented paid claim against your former roommate.

If you genuinely can’t cover it, tell the landlord immediately — same day. Ask for a written payment plan and offer to bring it current in 30 days. Do not ghost them back.

Document everything before anything else

Before you send a single message, screenshot everything.

Their move-out date confirmation, any text or email where they said they were leaving. Every Venmo, Zelle, or transfer showing they normally paid their share. Any text where they acknowledged their share of rent. The lease itself, showing both names. Your bank statement or receipt showing you paid the full amount.

Put it in one folder. This becomes your case file if you end up in small claims.

How to actually get the money back

Options, in order of effort.

Ask directly, in writing. Text or email. “Hey — you didn’t pay your $X for July rent. I covered it. Please send it by [date].” Keep it factual, no drama. About a third of the time this works because they genuinely forgot or thought their prorated math was different.

Go after their security deposit. If your lease is joint and they had a deposit in, ask the landlord to apply their portion of the deposit toward the shortfall. Landlord policies vary — some will, some won’t. Ask.

Contact their guarantor if there is one. A lot of college and young-adult leases have a parent or cosigner. That person is legally on the hook for missed rent. A polite email to the guarantor with your documentation attached moves fast.

Small claims court. Under $10,000 in most states, no lawyer needed, filing fees are $30–100. You bring your paper trail, show you paid, and get a judgment. Collecting on the judgment is a separate step, but the judgment itself often gets people to pay.

What about future rent — are you on the hook?

Depends on the lease. If it’s a joint lease, technically yes — until the lease ends or they get formally removed. That means until you find a new roommate or the lease ends, the landlord can come after you for the full rent every month.

Two urgent moves:

Talk to the landlord about a lease amendment. Some will let you remove the departing roommate if you can show they’ve moved out and you’re covering. Some won’t. Either way, ask in writing.
